User Agreement.

General

The following describes the terms and conditions between PiNkJazZ ("PinkJazz", "www.pinkjazz.com") and "you" the "user" in where PiNkJazZ offers you access to the information, communications, images, text, graphics, digital media, art works, products, items and other materials offered, supplied, produced, provided and/or delivered on [http://www.pinkjazz.com] and [http://www.pinkjazzstudio.com] (the “Site”), for your interest as long as the interests are for the lawful purposes described herein. By accessing or using the Site, you agree to be bound by the terms and conditions, set forth below (collectively referred to as this “Agreement”).

For the purposes of these terms and conditions, the term “Site” shall include the internet domain (pinkjazz.com), all services, information, database, communications, products, art work, items, images, text, graphics, messages and all other materials supplied by PiNkJazZ and pinkjazz.com, to you, whether posted on the Site or otherwise offered, supplied, produced, provided and/or delivered to you whether by way of electronic communications in the form of electronic mails, postal shipments, digital images, tangible and non tangible goods, or any other such method or technology used to deliver "content".

PiNkJazZ reserves the right to revise, withdraw or make changes to these terms and conditions and the Site, in whole or in part, at any time. All revisions, or withdrawals will be posted on the Site.

Use of Site

The products and services available on the Site are only offered to parties who in accordance with the provisions of this Agreement warrant that all information provided by you, including all information provided or submitted is true, correct and complete and you have the capacity and power to enter into this Agreement and use the services and purchase items provided on the Site.

All content (including without limitation all text, characters, brands, photographs, graphics, art work, items, products, digital and audio content) located on the Site is the exclusive property of it's proprietors or licensed to PiNkJazZ [http://www.pinkjazz.com]. Trademarks, service marks, characters and logos contained therein ("Marks"), are owned by or licensed to PiNkJazZ, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Without limiting the foregoing provisions, neither you nor any third party shall make use of the internet domain and contents of the Site in any manner that constitutes defamation, an infringement of rights, including copyright. You may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, repost or in any way exploit any part of this Site or its contents for any purpose. You may not download materials displayed on the Site for your own personal and or commercial use without written consent of PiNkJazZ or the intellectual property right owners. You agree Not to attempt to modify, circumvent, intercept or falsify any content, form, data, communications from, to or while in transit of the site.

Your Privacy

PiNkJazZ provides the facilities on the Site to permit you to submit, information, text (“Your Information”) to the Site directly. You are solely responsible for Your Information, and PiNkJazZ acts as a passive conduit for your online activity. You hereby certify that you are of legal age to make use of this site and the authorized individual to make financial transactions. With respect to Your Information, you warrant that:

a. Your Information (or any materials contained therein): (a) shall not be false, fraudulent, inaccurate, incorrect or untrue; misrepresenting or misleading; (b) shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition; (c) shall not be defamatory, libelous, offensive, unlawfully threatening or unlawfully harassing.

While PiNkJazZ will use reasonable effort to provide reasonable precautions to protect any information or material that is confidential in nature, PiNkJazZ does not guarantee that information transmitted through the Internet is secure or that such transmissions will be free from delay, interruption, interception or error. PiNkJazZ respects your privacy. The information you provide to us is used for the sole intent of communication for PiNkJazZ in conducting lawful transaction and ethical business practices between you the User - the interested party. Your information will never be disclosed, traded, or sold to any third party for any reason within the limits of our control unless subpoenaed by law.

Legal Notices

The trade marks, service marks, characters, "brands" and logo (the "Trade Marks") used and displayed on the Site are the registered and/or unregistered Trade Marks of PiNkJazZ or it's principle license owners. Nothing on this Site should be construed as granting, by implication, fair use, or otherwise, any license or right to use any of the Trade Marks displayed on the Site, without the written permission of PiNkJazZ or it's property right owners.

You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content including characters, artworks, items offered, products or brands from the Site without the prior expressed written permission of PiNkJazZ or the appropriate proprietors of such content.
